Terms of Service
1. Binding Agreement
By accessing or using the Foodashi website, API, developer tools, documentation, or any related services (collectively, the "Services") provided by Foodashi ("Foodashi", "we", "our", "us"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
You must be at least 16 years of age to use the Services. Paid plans are available only to users aged 18 or over, because under Hungarian civil law (Ptk.) a contract entered into by a minor with limited capacity may be voided by their legal representative. If you are between 16 and 18 you may use the free Hobby tier, and you represent that you have your parent's or legal guardian's consent to do so.
If you do not agree to these Terms, you must not access or use the Services. We reserve the right to update these Terms. We will provide at least 30 days' advance notice of material changes via email or in-app notification. If you do not agree to the revised Terms, you may terminate your account before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
2. Service Description
Foodashi provides a programmatic API that returns food-related data, including recipes, ingredient lists, nutritional estimates, allergen indicators, cooking instructions, and food imagery. Content is generated, curated, or augmented using artificial intelligence ("AI") systems, automated processes, and third-party data sources.
Foodashi is an informational tool only. It is not a food manufacturer, food distributor, healthcare provider, nutritional authority, medical device, or dietary advisory service.
3. Using Outputs Safely
Outputs can be shown automatically. If you build an application on the Services, you do not need a human to review each recipe before your application displays it, provided you keep the safeguards set out in Section 3 of the API License Agreement: make AI generation clear to your users, present nutrition as estimates and allergen information as indicative, make no medical or allergy-safety claims, and give users a way to report errors.
Some uses need a qualified person first. Clinical or medical nutrition, infant feeding, allergen control in food businesses, mandatory food labels, and printed or editorial publications presented as tested require review by a suitably qualified person before the content is used. These uses are described in the Acceptable Use Policy.
If you use a recipe yourself, use your own judgement, check ingredients and allergens against the actual products you use, and follow recognised food safety guidance for cooking temperatures and times.
4. AI-Generated Content Disclaimer
Content returned by the Foodashi API is generated or augmented by artificial intelligence. AI systems may produce inaccurate, incomplete, misleading, or fabricated information ("hallucinations"). This includes but is not limited to incorrect ingredients, unsafe food combinations, inaccurate cooking temperatures or times, incorrect nutritional values, and omitted allergens.
Foodashi does not guarantee the accuracy, correctness, completeness, safety, or fitness for any purpose of AI-generated content. You acknowledge that AI-generated recipes may contain material errors that could result in adverse health effects if followed without care.
In line with the EU AI Act (Regulation 2024/1689), Foodashi marks AI-generated content in a machine-readable way in API responses and image files. If you build an application on the Services, keep these markers in place and make it clear to your users that the content is AI-generated.
5. Food, Nutrition & Allergen Disclaimer
All allergen, nutrition, dietary, ingredient, caloric, and health-related information provided by Foodashi is automatically generated and may be incomplete, inaccurate, or unsuitable for individual needs. This data must not be relied upon on its own for medical, dietary, or allergy-critical decisions.
People with food allergies, intolerances, sensitivities, medical conditions, or dietary restrictions must check all ingredients, preparation methods, cross-contamination risks, and nutritional information against the actual products they use before consumption or reliance. Failure to do so may result in serious injury or death.
- Foodashi is not a medical, nutritional, or dietary authority.
- Generated recipes may contain errors, omissions, unsafe ingredient combinations, or incorrect preparation steps.
- Allergen indicators are computationally inferred and are not guaranteed to be complete or accurate.
- Nutritional values (calories, macros, micros) are estimates only, calculated from reference datasets, standard energy conversion factors, and, where no measured value exists, AI estimates. Actual values may vary.
- Cooking temperatures, times, and food safety instructions may be incorrect and should be checked against authoritative food safety guidelines.
- Allergen data provided does not constitute compliance with any food labeling regulation, including EU Regulation 1169/2011, US FALCPA/FASTER Act, UK Natasha's Law, or Australian Food Standards Code.
Foodashi is not responsible for decisions that you or others make about food preparation, consumption, allergens, or diet on the basis of this data, except where liability cannot be limited under the rules described in Section 11.
6. Marketing Language
Descriptive terms used in marketing materials, API responses, or documentation, such as "chef-grade," "authentic," "perfect," "gourmet," "professional," or "high-quality", are non-binding marketing expressions and do not constitute warranties, guarantees, or representations of any kind.
7. Accounts & API Keys
You are responsible for maintaining the confidentiality of your account credentials and API keys. You must not share, publish, or expose API keys in client-side code, public repositories, or any publicly accessible location.
You are liable for activity conducted through your account and API keys. This does not apply where you can demonstrate that the activity resulted from a cause not attributable to you, for example a security failure on our side, provided you notify us promptly at admin@foodashi.com once you become aware of it. Nothing in this section limits your statutory rights as a consumer. Foodashi reserves the right to suspend or terminate accounts that violate these Terms, exhibit abusive behaviour, or pose a security risk.
8. Payments, Billing & Refunds
Paid plans are billed on a recurring basis (monthly or yearly) via Stripe. By subscribing, you authorise recurring charges to your payment method. All prices are displayed in United States Dollars (USD). Your bank or payment provider may apply currency conversion fees. Foodashi does not currently add VAT to its prices: the seller uses Hungary's small-business VAT exemption (alanyi adómentesség). If a tax ever becomes due, it is shown at checkout before you pay.
By subscribing, you request and consent to immediate performance of the digital service, and acknowledge that your right of withdrawal is reduced proportionally to the service already consumed, as permitted by Article 14(3) of Directive 2011/83/EU.
Refunds are provided in accordance with our Refund & Cancellation Policy:
- Within 24 hours of your first payment or a renewal: full automatic refund and immediate termination, as long as you have used 5% or less of the plan and made no AI-powered requests; otherwise the next rule applies.
- Days 2 to 14 after that payment: a refund of the share you have not used (time or requests, whichever is higher) and immediate termination (EU/UK consumer right of withdrawal).
- After 14 days: cancel at end of billing period, no refund.
- Prepaid usage credit: the unspent balance is refunded when you move to the Hobby tier or delete your account, minus the card processing fee kept on that top-up.
Access is provided to the Service infrastructure, not to guaranteed outputs, uptime, or specific content quality. Fees are for API access, not for the accuracy of generated data.
9. Intellectual Property
The Foodashi platform, API infrastructure, documentation, branding, and proprietary algorithms are owned by Foodashi. Nothing in these Terms transfers ownership of our intellectual property to you.
AI-generated recipes, text, and imagery returned by the API may not be eligible for copyright protection under applicable law. Foodashi does not claim copyright ownership over AI-generated outputs and makes no representation regarding the intellectual property status of such content, including whether it may inadvertently resemble existing copyrighted works.
You are responsible for conducting appropriate intellectual property due diligence before publishing or commercialising content obtained through the API. If you believe API content infringes your copyright, contact admin@foodashi.com.
9A. Data Ownership
- Your Data: You retain all ownership rights in data you submit to Foodashi (account information, API queries, preferences, saved configurations). We do not claim ownership over your data.
- Foodashi Data: Foodashi retains all rights in the recipe database, nutrition data, ingredient data, AI-generated content, algorithms, models, and all data returned through the API, including any database rights. You may not claim ownership over raw API outputs. Third-party data that we pass on under an open licence remains subject to that licence, as described on our Data Sources page.
- License to Process: By using the Services, you grant Foodashi a limited, non-exclusive license to process your submitted data solely for the purpose of providing and improving the Services, as further described in our Privacy Policy.
- Aggregated Data: Foodashi may use anonymised, aggregated usage data (not personally identifiable) to improve the Services, develop new features, and generate industry insights.
10. Disclaimer of Warranties
READ CAREFULLY
THE SERVICES, API, AND ALL CONTENT (INCLUDING RECIPES, NUTRITIONAL DATA, ALLERGEN INFORMATION, AND FOOD IMAGERY) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. FOODASHI EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SAFETY, AND SUITABILITY FOR CONSUMPTION. FOODASHI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
Nothing in this section affects your statutory conformity rights as a consumer under Directive (EU) 2019/770 (Digital Content Directive) or applicable national law implementing it. Where mandatory consumer protection law provides rights that cannot be excluded or limited, those rights are preserved in full (see Section 15A).
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Foodashi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings, regardless of whether Foodashi has been advised of the possibility of such damages.
- Business users: Foodashi's total aggregate liability arising out of or related to these Terms or the Services shall not exceed the greater of (a) the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
- Consumers: where you are acting as a consumer, our total aggregate liability is limited to the total fees you paid in the twelve (12) months preceding the event giving rise to the claim. No minimum or maximum cash figure applies, and this limitation never reduces any remedy that mandatory consumer protection law gives you.
- Subject to the paragraph below, Foodashi is not liable for losses arising from how you or others use or rely on data provided through the Services, including decisions about food preparation, consumption, allergens, or diet.
Nothing in these Terms limits or excludes liability for: (a) intentional breach of contract; (b) damage to human life, physical integrity, or health caused by a breach of contract, which under Section 6:152 of the Hungarian Civil Code cannot be excluded or limited; (c) death or personal injury caused by negligence; (d) fraud or fraudulent misrepresentation; or (e) any other liability that cannot be limited or excluded under applicable mandatory law, including the laws described in Section 15A.
12. Indemnification
You agree to indemnify, defend, and hold harmless Foodashi, its officers, directors, employees, contractors, and agents from and against any and all claims by third parties, and the resulting damages, losses, liabilities, costs, and expenses (including reasonable legal fees), arising out of or relating to:
- Your use of the Services or presentation of API data to end users.
- Your failure to maintain the safeguards required by the API License Agreement regarding AI transparency, food allergens, nutritional data, or food safety information.
- Any allergic reaction, adverse health event, or injury claimed to result from reliance on data obtained through the API where you did not maintain those safeguards.
- Your failure to comply with applicable food safety, allergen labeling, consumer protection, or data privacy laws in any jurisdiction where you operate.
- Your violation of these Terms or any applicable law or regulation.
- Any content, applications, or services you create using the API.
This indemnification obligation applies to the extent permitted by applicable law. It does not apply to the extent a claim results from Foodashi's own intentional breach, and it does not apply to consumers where prohibited by mandatory consumer protection legislation, including EU Directive 93/13/EEC on unfair contract terms.
13. Force Majeure
Neither party shall be liable for failure or delay in performing obligations where caused by circumstances beyond reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions or sanctions, failure of third-party cloud infrastructure (including Cloudflare, Supabase, Stripe, or AI model providers), internet backbone failures, cyberattacks, power outages, and changes in law or regulation.
If a force majeure event continues for more than sixty (60) days, either party may terminate without liability.
14. Termination
Either party may terminate at any time. You may cancel your subscription via the Developer Console. Foodashi will provide at least 30 days' written notice before terminating access without cause for users on a paid plan. Foodashi may suspend or terminate your access immediately if you breach these Terms, engage in abusive behaviour, or pose a risk to the security or integrity of the Services.
Upon termination, your API keys will be deactivated and your access to paid features will cease. Sections 3 to 6, 9, 9A, 10 to 13, 15, 15A, and 16 survive termination. (Section 9A, Data Ownership, is named explicitly so there is no doubt that it survives: it governs who owns API output after the relationship ends, which is precisely when it matters.)
15. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to conflict of law provisions, subject to the Regional Terms in Section 15A.
Any disputes shall first be attempted to be resolved through good-faith negotiation for a period of thirty (30) days. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Budapest, Hungary.
EU consumers retain the right to bring proceedings in their country of residence under applicable consumer protection laws. Nothing in these Terms affects statutory consumer rights that cannot be waived by contract.
Conciliation Board (Békéltető Testület)
If you are a consumer and we cannot resolve your complaint directly, you may refer the matter free of charge to a conciliation board. Conciliation boards operate alongside the county chambers of commerce and industry and are independent of Foodashi. The board competent for our seat is:
Budapesti Békéltető Testület (Budapest Conciliation Board)
Office: 1016 Budapest, Krisztina krt. 99., 1st floor 111.
Postal address: 1253 Budapest, Pf.: 10.
Telephone: +36 (1) 488-2131
Email: bekelteto.testulet@bkik.hu
Website: bekeltet.bkik.hu
Submit a request online: bekeltet.bkik.hu/urlap/kerelem-online-benyujtasa
You are not obliged to use this board: you may instead approach the conciliation board competent for your own place of residence or stay. A list of all Hungarian conciliation boards is available at bekeltetes.hu. Consumers resident elsewhere in the EU may also contact their national European Consumer Centre. Using a conciliation board does not affect your right to go to court.
15A. Regional Terms
We offer the Services worldwide under one set of terms. Where you live can give you rights that a contract cannot take away. If anything in these Terms or the API License Agreement conflicts with a rule below, the rule below applies.
- European Union and EEA consumers: the choice of Hungarian law does not deprive you of the protection of the mandatory consumer laws of the country where you habitually live (Article 6(2) of Regulation (EC) No 593/2008, "Rome I"), and you may bring proceedings in your country of residence.
- United Kingdom: nothing in these Terms excludes or restricts liability for death or personal injury resulting from negligence, or any other liability that cannot be excluded or restricted under UK law.
- United States: some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so parts of Sections 10 and 11 may not apply to you, and you may have other rights that vary from state to state.
- Australia: our Services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these Terms excludes, restricts, or modifies them. Where the Services are not of a kind ordinarily acquired for personal, domestic, or household use, our liability for failing to comply with a guarantee is limited, to the extent the law allows, to supplying the Services again or paying the cost of having them supplied again.
- Everywhere else: if the law of your country gives you rights that cannot be waived by contract, those rights continue to apply, and the relevant parts of these Terms apply only as far as that law allows.
Business customers: mandatory rules that protect businesses as well as consumers, such as Section 6:152 of the Hungarian Civil Code, also continue to apply.
16. General Provisions
- Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
- Entire Agreement: These Terms, together with the Privacy Policy, Refund Policy, API License Agreement, and Acceptable Use Policy, constitute the entire agreement between you and Foodashi. A separate written agreement signed by Foodashi prevails over these Terms where it says so.
- No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without Foodashi's written consent. Foodashi may assign its rights freely in connection with a merger, acquisition, or sale of assets.
- Contact: For legal inquiries, contact admin@foodashi.com
